Indictable Felonies that are Ineligible for Expungement in New Jersey

Not all indictable felonies are eligible for expungement. Some of the indictable felony offenses that cannot be expunged no matter how much time has passed include:
- Arson
- Robbery

- Aggravated sexual contact
- Abuse of public office
- Endangering the welfare of a child

Eligibility for Indictable Felony Expungement in New Jersey
In order to be eligible for expungement of an indictable felony in New Jersey, you must meet the strict criteria set by the law. Some of the conditions you must meet include:
- You must only have one indictable felony conviction. Your indictable felony conviction must not be for a felony that is ineligible for expungement. If you have multiple indictable felony offenses and disorderly persons offenses, you must have been convicted for these offenses at the same time e.g. in the case of a crime spree. The convictions will therefore be considered as a single conviction for the sake of the expungement process.
- You must not have been convicted of more than three disorderly persons offenses
- You must not have been convicted of other crimes or disorderly persons offenses
- The required waiting period must have elapsed before submitting your petition for expungement
Changes to New Jersey’s expungement laws have now made it possible to expunge an indictable felony conviction even when you have more than one unrelated felony conviction. However, you will only be able to expunge the most recent indictable felony conviction. If the most recent indictable felony is one that is ineligible for expungement, then you will not be eligible for expungement even if the previous felony is one that can be expunged under the new laws.
