What is Expungement?
Expungement as defined under NJ Rev Stat 2C:52-1 (2019) is the ‘extraction, sealing, impounding or isolation of all records on file within any court, detention or correction facility, law enforcement or criminal justice agency concerning a person’s detection, apprehension, arrest, detention, trial or disposition of an offense within the criminal justice system.’
In simple terms, expungement is the process through which records of criminal arrests or convictions are erased from public records. If you are successful with the New Jersey expungement process it will be as if your arrest or conviction did not occur. Your record will not appear on a criminal background check. However, it will still be visible to law enforcement agencies.
The New Jersey Expungement Process Explained
There are two types of expungement processes available in New Jersey:
- The paper filing process
- The Electronic (e-filing) process
The Paper Filing Process
Step 1: The first step is determining your eligibility for an expungement. This depends on various restrictions including the offense you committed and the time that has elapsed since your arrest or conviction.

Electronic Filing Process
This is a more convenient and accessible New Jersey expungement process.
Step 1: Determine your eligibility
Step 2: Gather the relevant information for the filing process. The e-filing system will give you access to your criminal records by simply entering your case number. However, these records may not be complete. You may therefore need to input additional information.
Step 3: Either you or your attorney will need to input the relevant information to complete the filing and submit the petition to the system. The e-filing system will distribute electronic copies of your completed petition to the relevant government agencies.
Step 4: An expungement hearing will be scheduled where a judge will determine whether to grant or deny your petition. If your petition is granted an electronic copy of the signed order will be distributed to the relevant government agencies.
