New Jersey Expungement Eligibility Requirements
There are three areas set by New Jersey law N.J.S.2C:52-2 where expungements are possible:
- Traditional expungement – you may be eligible for this type of expungement if you were convicted of an indictable offense (other states call this a felony) and have no more than 3 convictions for disorderly persons offenses. You may also be eligible for this type of expungement if you have no more than 5 disorderly persons offenses. However, in this case, you should not have any indictable convictions. Those with no indicatable offenses and that have two or fewer disorderly persons offenses can also seek expungement for municipal ordinance violations.
- Clean slate expungement – This type of expungement allows you to have your entire criminal record expunged after 10 years. There is no limit to the number of disorderly persons convictions or indictable offenses to qualify for this type of expungement. However, you should not have been convicted for an offense that is not eligible for this type of expungement. Your request will otherwise be denied.
- Drug conviction expungements – In order to be eligible for this type of expungement, you should have completed a drug rehabilitation program as ordered by the court. You should also not have committed a crime that is ineligible for expungement or have been convicted of an offense that is more serious than a petty disorderly offense during the period of your probation program or after the probation period.

Crimes for Which You Will Not Be Eligible for Expungement in New Jersey
It is important to note that there are crimes that are not eligible for expungement. These are more serious crimes. They include:
- Kidnapping
- Sexual assault and other sexual offenses
- Child pornography
- Homicide
- Robbery
- Sexual conduct with a minor
- Arson
Time Period Required for New Jersey Expungement Eligibility
The time period required for New Jersey expungement eligibility varies depending on the offenses involved. It also depends on the type of expungement you are seeking. For a Clean Slate expungement, you will need to wait for 10 years from the end of your probation. If you are seeking a traditional expungement, you will need to wait five years from the last conviction. If there are compelling circumstances and you are seeking expungement for an indictable conviction and up to 3 disorderly persons offenses, you will need to wait for 4 years. If there are compelling circumstances and you are seeking expungement for five disorderly persons offenses with no indictable conviction, you will wait for 3 years. To expunge an entire juvenile record, the waiting period is 3 years.
