Options for Expungement of Drug Offenses in New Jersey

New Jersey Law provides for the opportunity to expunge some criminal convictions or arrests after a waiting period of three to ten years depending on the offense and the circumstances of your case. This period begins after the completion of your rehabilitation or jail sentence. However, those that have graduated from New Jersey’s Drug Court program can have their criminal records expunged without having to wait three or ten years.

Drug Court Expungement

An amendment to New Jersey’s expungement law in April 2016 provided for what is known as Drug Court expungements. Under this new law, drug addicts can have their criminal histories expunged if they successfully graduate from Drug Court.

New Jersey’s Drug Court program was created to help drug addicts get the help they need. Through this program drug addicts can access rehabilitation programs and make a recovery. Successful completion of the program makes the former drug addict eligible for expungement of their entire record of arrests and convictions. This allows them to access opportunities such as employment and further education. They are therefore more likely to get their lives back on track.

In order to be eligible for expungement you must:

  1. Complete drug court
  2. Not be convicted of another crime during the drug court program

Drug Court Program Process

New Jersey’s drug court program involves four phases. These are as outlined below:

Stabilization

During this phase, you will be required to attend drug treatment as recommended by a medical provider. This phase of the Drug Court program lasts for not less than 3 months.

Positive change

This phase involves living in a permanent group home. You will be assigned a sponsor to support you with your drug addiction. You will also be required to work either part-time or full-time while attending school. This phase lasts not less than 6 months.

Relapse prevention

This phase lasts a minimum of three months. It involves attending self-help meetings as well as maintaining contact with your probation officer.

Graduation

This is the final phase of the drug court program. After completion of all other phases, you will be required to pay your fines and restitution as required by the court. You will also be required to report to the court every quarter. You may also be required to mentor new members of the Drug Court program.
