Before you can be eligible for and file for an expungement, you must meet the following criteria:

  • For felonies, you must complete the term of your sentence, pay any fines, and have no criminal convictions in other states or over three misdemeanors in New Jersey. Furthermore, you can only expunge one felony in your lifetime unless multiple felonies are combined into a single conviction or are part of the same crime (in which case you must refer to NJ Rev Stat § 2C:1-8 (2022) on conduct that constitutes more than one offense).
  • For misdemeanors, you must complete your sentence and pay any assessed fines. You cannot have over five misdemeanors expunged.
  • For juvenile offenses, you must complete your sentence and pay any assessed fines and you cannot have been ruled a juvenile delinquent or have been convicted of an adult crime to have juvenile records expunged.
  • Drug possession charges – You must complete your jail sentence and pay any assessed fines. Drug distribution or sales offenses can only be expunged if they are third-degree offenses or lower and involve less than 25 grams of marijuana or less than 5 grams of hashish.
  • If your charges are dismissed due to pre-trial intervention, you must simply complete the terms of your program before you can have your record expunged.
  • If you are arrested without a conviction, you can file for an expungement as soon as your charges are dismissed.

For each of these, there is a Clean Slate law that allows individuals who have not been convicted of any crime for over 10 years to file for an expungement. There are also various waiting periods for different offenses, ranging from six years to six months based on the nature of your crimes, the decision of the courts, and the rules that apply to your case.
